Have your say on the proposed amendments to regulation of lotteries in South Australia.

What's being decided?

To support the commencement of the Lotteries Act 2019, amended regulations are required to outline the rules and requirements for the various lottery types.

Regulations have been drafted with the proposed amendments so we can get your feedback on the proposals.

We are particularly interested in your views regarding whether:

  • the rules provide the right balance between supporting businesses and organisations, and maintaining the integrity of lotteries
  • the rules provide the community with sufficient information about a lottery to make informed decisions before purchasing
  • you support allowing card jackpot lotteries for fundraising and the proposed rules
  • you have any concerns about how lotteries are conducted and advertised, and if so can you provide examples
  • any of the proposed rules are complicated to understand or difficult to comply with.

To inform our review we are seeking your feedback on the draft Lotteries Regulations 2021.

Note: This review relates to lotteries conducted under the current Lottery and Gaming Act 1936 (such as fundraising raffles and bingo). It does not include lotteries conducted by, or on behalf of, the Lotteries Commission of South Australia, under the State Lotteries Act 1966 (such as X lotto and Keno).

Background

Many community organisations use lotteries as a way to raise funds and for businesses to promote their goods and services. We want to make sure these activities are supported and remain viable, by finding the right balance between meeting community expectations around the conduct of lotteries without placing unnecessary regulatory burden on those who conduct them.

There are various types of lotteries that can be conducted, each with their own rules and requirements including:

  • major and minor lotteries
  • instant lotteries
  • bingo and
  • trade promotions.

In 2019, a review of the existing Lottery and Gaming Act 1936 (the LGA) was undertaken to simplify and modernise the regulation of lotteries in South Australia. A framework was established that distinguishes between unlawful and lawful lottery activities and allows for licensing various lottery products and activities.

As a result, the lottery provisions from the LGA were incorporated into the new simplified Lotteries Act 2019, which passed Parliament in December 2019. The new Act, which is due to commence on 12 December 2021, will better reflect contemporary needs of businesses and the community and provide greater clarity and structure to the licensing framework for lotteries and the supply of lottery products in SA.
