Aboriginal Heritage Act – Residential Development at 91 Batson Parade, Hindmarsh Island

Maxwell Nominees Pty Ltd (Applicant) has submitted an application to the Minister for Aboriginal Affairs (Minister) for authorisations to build a new house at 91 Batson Parade, Hindmarsh Island (the application), The application area is which is known to contain Aboriginal ancestral remains.
The project would involve the following works within a portion of the application area:
- excavation, removal and relocation of Aboriginal heritage, including Aboriginal heritage discovered during construction
- ground disturbing works associated with construction including excavation for footings and site clearance
- soil backfilling and removal of excess soil/material from the application area
- installation of two rainwater tanks
- other supporting works that may be required to complete the Project
Under the Aboriginal Heritage Act 1988 (SA) (Act), authorisations under sections 21 and 23 are required to excavate land for the purposes of uncovering Aboriginal sites, objects and/or ancestral remains (together, heritage) and to damage, disturb and/or interfere with heritage.
Your views will help decide whether ministerial authorisations should be granted to the Applicant, and inform necessary conditions for the management of Aboriginal remains located at the application area, and any other Aboriginal heritage discovered.
Section 13 of the Act requires the Minister to consult with relevant Traditional Owners, the State Aboriginal Heritage Committee (Committee) and any other Aboriginal people or organisations that he considers may have an interest in this matter.

2. If the authorisations were granted, would you seek that the authorisations be conditioned in any way? Please provide example conditions
3. What are your views on the project proceeding as proposed, including:
- the impacts to Aboriginal heritage that are proposed?
- the proposed protection and management of Aboriginal heritage?
4. Do you have any other views you wish to share with the Minister before the application is decided?

All submissions must be received by AAR no later than Monday, 8 June 2026.
You may request that AAR keeps any cultural information in your submission confidential. Where possible AAR will accommodate that request; however procedural fairness may require that the Applicant be provided with as much information as possible to respond. AAR will discuss with you any request you may make for your submission to be considered on a confidential basis. Once the consultation has closed, submissions and the Applicant’s responses to them will be provided to the State Aboriginal Heritage Committee, and the Committee’s advice will then be sought.
All submissions, the Applicant’s responses to them, the Committee’s advice and AAR’s recommendations will be forwarded to the Minister to assist the Minister to decide the application.
