What's being decided?

The Local Design Review Code Amendment seeks to amend the Planning and Design Code (Code) so that a local council can participate in the Local Design Review Scheme.

The proposed Amendment would enable a council to specify certain classes of development to be eligible for Local Design Review in their area. This process would occur when a council registers under the Local Design Review Scheme.

Your feedback can influence the provisions that are proposed for inclusion in the Code.

Background

Section 121 of the Planning, Development and Infrastructure Act 2016 enables the Minister for Planning and Local Government (the Minister) to establish a design review scheme, where a person who is considering undertaking types of development specified in the Code may apply to a design panel for design advice.

In February 2021, the Minister approved the Local Design Review Scheme to come into effect on 1 July 2021. This followed extensive public consultation on the draft Scheme that occurred in 2020.

The Local Design Review Scheme provides a consistent state-wide approach for councils to establish their own design panels and provide Design Review for locally assessed development proposals.

The proposed Local Design Review Code Amendment is now required to give effect to the Scheme by enabling councils to specify classes of development to be eligible for Local Design Review in their area. This process would be completed when a council registers under the Local Design Review Scheme and is represented in the image below.

Proponents of the eligible classes of development will then be able to apply to that council to participate in Local Design Review.

This consultation builds upon the collaborative approach to develop the Local Design Review Scheme and provides an opportunity for users and interested parties to comment on the proposed provisions

What are the next steps?

Once consultation has closed, the State Planning Commission will consider all formal submissions to determine if the proposed Code Amendment is suitable for adoption or if changes should be made.

All submissions and an Engagement Report will be published here and on the PlanSA portal, and provided to the Minister for consideration.

Once the Local Design Review Code Amendment is approved and adopted by the Minister, the Local Design Review Scheme can be used by local councils and proponents to support high-quality design in our communities.
