Will sale of the property impact public access to the Palais Hotel?
There is no intent to change the general public’s access, enjoyment and use of the Palais Hotel from what is currently available under the existing lease arrangements.
If the property is sold, will the property be developed?
The land is zoned Open Space. Any future development of the land proposed by Semaphore Palais Hotel would be assessed and the community consulted as required under the Planning, Development and Infrastructure Act 2016 and other legislation including the Heritage Places Act 1993.
The Semaphore Palais Hotel Pty Ltd will continue to maintain the property to a high standard for the public’s enjoyment as it has during the lease.
How will the sale of the property impact the State Heritage Listing of the building?
There will be no change or impact to the State Heritage listing of the building. The property is protected under its Heritage listing pursuant to the Heritage Places Act 1993 which is registered against the land title.
The owner of the property, whether in government or private ownership, must abide by, and comply with, the requirements of the Heritage Places Act 1993.
How is the sale price determined?
Crown land must be sold at market value. Market value is determined by an independent valuer as required under the Crown Land Management Act 2009.
Will sale of the land impact public access to the foot/bike path or foreshore?
There will be no change to the public’s access, enjoyment and use of the foot/bike path, or foreshore, as these do not form any part of the Palais Hotel Crown land. There is no intent to change the land use.
The Palais Hotel land parcel sits along side a waterfront land parcel but is not itself waterfront land as defined in the Crown Land Management Act 2009.
What happens after the 30 day consultation?
All feedback received will be collated and presented to the Minister for Climate, Environment and Water to consider before any decision regarding sale of the property is made.
