The Department for Energy and Mining (DEM) is seeking comments on a draft Bill to amend the Petroleum and Geothermal Energy Act 2000 (the PGE Act).

What's being decided?

To maintain leading practice regulation of the petroleum, gas storage, pipeline transmission and geothermal energy industries in South Australia, the Department for Energy and Mining (DEM) is reviewing the current Petroleum and Geothermal Energy Act 2000 (PGE Act).

A draft Bill amending this Act has been released for public comment.

Background

A draft Bill to amend the Petroleum and Geothermal Energy Act 2000 (PGE Act) was introduced into Parliament on 25 August 2021. However, it did not progress before the change of government in March 2022.

A new draft Bill has been prepared with the majority of amendments consulted on in 2021. The bulk of changes proposed to amend the PGE Act are improvements to efficiency, clarity and transparency of existing regulatory processes.

Previous engagement has included four weeks of public consultation on an Issues Paper in February 2021, and three weeks consultation on a draft Bill in June 2021.

The hydrogen generation provisions included in the draft Bill of 2021 have been removed, and will now be included in the South Australian Government’s proposed separate legislation to licence and regulate hydrogen energy.

Public consultation on the Bill will run for a four-week period.

DEM has prepared a summary of key amendments, a clause-by-clause description and the PGE Act including amendments to accompany the draft Bill.
