What's being decided?
We are in the process of introducing two new data regulations to the Health Care Regulations (2008) to support statewide health service planning, population health planning and improve patient health outcomes.
- Private Health Facility Data Regulation (Health Care (Provision of Data and Statistics) Variation Regulations 2021)
- This Regulation will require private health facilities (private hospitals and private day procedure centres) to provide identified patient activity data to the Department for Health and Wellbeing (DHW).
- There are two sections to the new Regulation:
- Regulation 21AA relates to private hospitals.
- Regulation 21G relates to private day procedure centres.
- Expanded Cancer Data Set Regulation (Health Care (Reporting of Cancer) Variation Regulations 2021)
- This Regulation will require public and private hospitals, health services and pathology laboratories to provide data on cancer treatment, prognosis (predictive factors for how the cancer will behave) and recurrence (when a cancer thought to have been cured returns) to the DHW.
- There are two sections to the new Regulation:
- Regulation 27 relates to public and private hospitals, health services.
- Regulation 28 relates to pathology laboratories.

What are the next steps?
As part of the consultation process the DHW is engaging directly with impacted health care providers to seek their feedback on the draft Regulations.
We will review and consider all feedback to finalise the draft Regulations. The new Regulations will come into effect on 1 July 2022.
While the Regulations are being drafted and finalised the existing data reporting requirements for all health care providers will remain in place.
