What's being decided?

We want to hear from you about a proposal from Mr Adrian Mollenmans (Flinders University PhD candidate), Professor Amy Roberts (Flinders University) and Professor Lester-Irabinna Rigney (University of South Australia) (together, the Applicants) to undertake research activities on or near the Point Pearce Peninsula/Burgiyana, Dead Man’s Island/Mungari and Wardang Island/Waraldi.

Your views will help the Premier decide whether to authorise potential damage, disturbance or interference with Aboriginal heritage, and the removal of an Aboriginal object from the State, that may occur as a result of this proposal.

Background

The Premier of South Australia, who is responsible for the administration of the Aboriginal Heritage Act 1988 (SA) (Act), has received an application for authorisations under sections 23 and 29(1)(b) of the Act from the Applicants.

Section 23 of the Act makes it an offence to damage, disturb or interfere with Aboriginal heritage without the Premier’s authorisation, and section 29(1)(b) makes it an offence to remove an Aboriginal object from the state without the Premier.

The Applicants propose to undertake a research project involving the recording of Aboriginal sites on the Yorke Peninsula, and the collection and analysis of archaeological samples. Any radiocarbon dating will require the transfer of samples outside of South Australia for testing. This research proposal would be undertaken at Aboriginal sites located within 14 separate research zones on the Yorke Peninsula/Guuranda and adjacent islands, some 180 km northwest of Adelaide (together, the Application Areas). The research proposal, if authorised, would be undertaken in collaboration with the Narungga Nation Aboriginal Corporation and the Point Pearce Aboriginal Corporation.

Prior to considering whether to grant the authorisations, section 13 of the Act requires the Premier to consult with Traditional Owners, the State Aboriginal Heritage Committee (Committee), and other Aboriginal parties that he thinks may have an interest in the matter.

  1. Should the authorisations sought be granted to the Applicant? Why or why not?
  2. If the authorisations are granted, what conditions, if any should be imposed on them?
  3. Are there any other matters that the Premier should be aware of when considering the application?

What are the next steps?

Unless otherwise requested, consultees submissions will be forwarded to the Applicant for comment. Once the public consultation period has closed, submissions and the Applicant’s comments about them will be forwarded to the Committee. The Committee’s own views about the application will then be sought. AAR will collate consultee submissions, the Applicant’s responses to them, the Committee’s advice, and its own recommendations to the Premier within a single brief to assist him to make a final decision about the application.
