Share your views about proposed new changes to the Mental Health Act 2009
What's being decided?
The Office of the Chief Psychiatrist is conducting a supplementary consultation to ask additional questions on what further changes could be made to the Mental Health Act 2009 that might prevent critical incidents and improve emergency mental health care. Any extra changes will be added to a draft Act that will then be circulated for further round of consultation in the first part of 2025.
The OCP welcomes the opportunity to align mental health legislation with contemporary mental health and human rights-based practice.
Background
Drafting work on a new Mental Health and Wellbeing Act is now occurring based on the South Australian Law Reform Institute review. We are grateful for previous responses to consultations.

What are the next steps?
We will use your feedback to inform the development of a draft Bill to make amendments to the Mental Health Act 2009. Changes to the Act will need to be agreed by Cabinet and both houses of Parliament.
